Terms and Conditions

The following provisions govern the use, transfer and liability imposed upon data residing on Internet servers operated on behalf of TAG Limited, using the domains tagsafety.com or ahead4heights.com including connection by HTTP, FTP, SMTP and other electronic protocols, hereafter referred to as the 'Services', by all users accessing via UDP or TCP/IP, hereafter referred to as the 'Users'.


The Services are generated, maintained and collated by the Administrators, namely TAG Limited, it's agents, employees, representatives and suppliers including but not limited to the agents and organisations supplying hosting, connectivity, name resolution, data transfer and management.


Local connections from trusted registered users may be exempted from certain aspects of these limitations, as described in their access agreements.


All material to which anonymous access is permitted by the operating system is available for personal or academic professional use without charge. Use of the material for personal or commercial profit or gain is not permitted without prior express agreement of the authors and administrators of the Services.


Integrity of Data

All material available to anonymous users via the Services is closely monitored to ensure that no adverse effects are likely. Viruses, intentionally harmful software or other potentially damaging material, views, instructions or protocols are removed wherever found. Material infriging the Copyright of others is removed wherever found. In all cases where such infringement is notified to the Administrators a period of 28 calendar days shall be allowed for removal of such material. Notwithstanding these claims the Administrators do not accept any liability for material failing to meet these limitations where such failure is unintentional or accidental.


External Links

The Services contain links to external information sources, both electronic and conventional. The Administration and the Authors accept no liability for the content of material accessed by external links, nor do they accept any liability for material transferred through the Services where the original and final destinations of the transfer lie outside the physical architecture of the Services, including but not limited to electronic newsgroups, discussion services and interactive communication services.


Limitations of Warranty

  1. THE SERVICES ARE PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE, OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
  2. THE USE OF THE SERVICES IS AT YOUR OWN RISK.
  3. ACCESS TO THE SERVICES MAY BE INTERRUPTED AND MAY NOT BE ERROR FREE.
  4. NEITHER TAG LIMITED, THE SERVICES ADMINISTRATION, NOR ANYONE ELSE INVOLVED IN CREATING, PRODUCING OR DELIVERING THE SERVICES OR THE MATERIALS CONTAINED THEREIN, SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICES.

Impartiality and Advertising

The Services seek to remain impartial to political and social pressures. Where biassed political, social or personal views are found they will be removed. This limitation applies to all material in the Services including personal material as described above.


Indemnification

You agree to hold harmless and indemnify the Services Administrators, authors and the contributors to the Services, against any liability for any claims and expenses, including reasonable legal expenses, relating to any violation of the terms of this Agreement or arising out of any materials submitted by you where such submission is permitted.


Limitations

This Agreement shall be governed by the laws of the United Kingdom applicable to agreements wholly made and performed in the United Kingdom. In the event that you believe you have been irreparably harmed by any cause of action relating to the Services, you agree to inform the Administrators in writing and grant their agents thirty (30) full calendar days to cure the harm before initiating any action. Postal address for such notification is available here, the notification must include therein full postal contact details for the complainant to be considered valid. Notification by electronic means including but not limited to electronic mail or facsimile transmission shall not be accepted as constituting notififcation in writing. Any legal action or proceeding arising out of or relating to this Agreement or a breach thereof, shall be instituted in a court of competent jurisdiction in the United Kingdom, and you hereby consent and submit to personal jurisdiction of such court, waive any objection to venue in such court and consent to service of process by overnight courier or express paper-format mail at your last known address. Any cause of action initiated by you must be initiated within one (1) year after the claim or cause of action has arisen or be barred.


Acceptance Procedure

By requesting transfer of material from the Services by any electronic protocol you agree with all the terms and conditions of this Agreement.


This agreement issued 27 May 2004 under United Kingdom law and shall be extant until specific revokation.
